TERMS AND CONDITIONS - UPDATED 23/07/24
Registration
- The Blackened Teeth Ltd supply B2C & B2B - we require evidence of business trading prior to any supply to new customers. We reserve the right to reject any application that does not meet our criteria and to withdraw the supply to any customer at our discretion.
Payment
- All goods must be paid for in full prior to delivery, or upon collection. Our preferred payment method is BACS/ bank transfer; please note your Order Number in the We require cleared funds and only accept payment by cheque at our discretion.
- All goods remain the property of The Blackened Teeth Ltd until paid for in full.
Delivery
- Our minimum order value is £450 + VAT, where applicable. Orders to Mainland UK will incur the delivery charge shown at checkout. Please note we only deliver to Mainland UK & Ireland. All other UK and global destinations can be shipped to, but delivery will be quoted on a case-by-case basis. Shipping price for International Orders will be added at time of invoicing (this will show on an Order Confirmation as TBC) - should you require a shipping estimate for an International order prior to placing the order please email us with the entire contents of your proposed order and include your shipping address (wholesale@theblackenedteeth.com).
- Approximate delivery times can be quoted when an order is placed. Until a specific date is confirmed by a member of our staff delivery times are approximate and we will not be liable for any consequential loss caused by late delivery.
- If an arranged delivery cannot be made due to non attendance, the recipient retailer will incur a re-delivery fee (payable prior to the re-delivery attempt being made)
- It is the responsibility of the recipient to ensure sufficient access is available to safely deliver goods to their premises. Off-loading assistance for the delivery driver may also be necessary.
- Pallet deliveries are used for volume orders both UK and Internationally, should you not be able to accept pallet deliveries when placing a high volume order please let us know prior to invoicing).
- Shipping delays due to customs checks and various other factors can affect the delivery of goods; this is beyond The Blackened Teeth's control and therefore cannot be held liable for the delivery date changing.
- Please be aware that International orders will incur Customs Duties to be paid upon arrival into the destination country. You will be contacted by the designated courier for payment (via email), not by The Blackened Teeth. We do not offer 'Duties Paid' shipping options to Wholesale Clients.
Stock Information & Pricing
- Stock and pricing information is available on our website for registered users only. Prices will not be discussed over the phone.
- All of our products are handmade or hand finished. This is how they are intended, and therefore small variations in finish are to be expected. For example, plaster items can ever so vary slightly in size and shape. Marbled products will vary in pattern. Resin products can contain minor bubbles. These handmade effects are not faults, and will not be considered to be, with respect to customers wishing to return items to you/you to us.
- Stock information supplied is as accurate as possible. We do not recommend customers to sell/ take deposits on goods not yet in their possession. The Blackened Teeth will not accept any responsibility if goods become out of stock/shortages and we therefore cannot supply. The sale of goods not owned by the customer is entirely at their own risk.
- All prices listed are exclusive of VAT. Minimum order value excludes VAT.
- The Blackened Teeth can provide a minimum SRP (Suggested Retail Price) for their products. This price is intended as a guideline to aid retailers, but must not be used for any form of promotion or marketing by the retailer by way of comparison to their retail price. You are able to price above the SRP guideline.
- The Blackened Teeth Ltd reserve the right to alter wholesale prices, and our own retail prices, at any time. Wholesale orders are executed at prices in force at time of dispatch date. Should any product prices change during the production of your order placed, you will be notified prior to being invoiced.
Returns Policy
- Please inform us of any damages or discrepancies on delivered goods within 14 days of receipt of goods. After this time The Blackened Teeth will accept no responsibility.
- Notification of damages/shortages must be given in writing, preferably with accompanying photographic evidence to wholesale@theblackenedteeth.com
- We will arrange collection and replacement, credit or refund of any damaged goods only if in their original packing. Returns must be clearly marked with the customer's business name, invoice number and a description of the fault.
- Where possible, spare parts will be provided instead of entire replacement items.
- Collection of damaged goods will be at the discretion of The Blackened Teeth Ltd and must coincide with local deliveries.
- Only faulty or damaged goods can be returned. We do not operate sale or return.
- The Blackened Teeth Ltd reserve the right to refuse collection of goods if not packaged and labelled correctly.
- For orders delivered to UK addresses by The Blackened Teeth, which are then shipped overseas as arranged by customers, any goods must be returned to the UK address which The Blackened Teeth initially delivered to for any returns to be honoured.
- The Blackened Teeth Ltd reserve the right to void any unused credit notes after 18 months from the original issue date.
Internet Sales
- Proof of trade must be provided by online retailers before opening an account, The Blackened Teeth Ltd reserve the right to close or refuse purchasing accounts at any time. New applications from customers without retail or commercial premises, or selling from a residential address, may have their accounts refused.
- Our product photography may be used to advertise The Blackened Teeth products that you are going to resell. They are available by contacting Rebecca at rebecca@theblackenedteeth.com, under permission of The Blackened Teeth Ltd.
- If clients own photographs of The Blackened Teeth products are used (produced by the wholesale retailer themselves); they must be of high quality and professionally taken. All photography needs to reflect The Blackened Teeth's brand standards; you may be contacted by our team should they fail to do so and asked to remove the content from the internet.
- It is not permitted for any retailers to use any imagery from The Blackened Teeth's social media/website that has been generated by other customers or brand affiliates i.e. on reviews, or social media posts.
- The Blackened Teeth product code numbers or (website) product descriptions are not permitted to be used by retailers for advertising or marketing.
- All products made by The Blackened Teeth, must state they are made by The Blackened Teeth on retailers websites. Not adhering to this will result in retailers having their purchasing account closed immediately.
- The Blackened Teeth Ltd own the copyright of the imagery, text and design of the website. Customers found to be using any of these elements and promoting as their own, without prior permission with regards to imagery, will have their purchasing account closed immediately.
- As of 1st September 2019, The Blackened Teeth Ltd does not permit the sale or promotion of their products via multi-retailer websites. Including (but not limited to): eBay, Amazon, Etsy, Trouva, Facebook Marketplace, Gumtree and NotOnTheHighStreet. Should you need clarification as to whether you can sell on a specific website, email Lee (lee@theblackenedteeth.com). Any new or existing customers found to be using multi retailer websites to market our products will have their purchasing account closed immediately.
- All The Blackened Teeth Ltd online retail customers must have their postal address and contact telephone number clearly visible on their website.
- Online retailers are not permitted to stimulate the sale of The Blackened Teeth Ltd products in a manner that could be considered to negatively impact or damage the reputation of The Blackened Teeth Ltd, or their products. This includes the use of automatic repricing software.
- The Blackened Teeth Ltd products are not permitted for sale via customers' websites promoting overly regular/unrealistic "flash sale" events and discount code promotions.
- The Blackened Teeth Ltd does not permit retailers to sell returned (to retailer) goods that have been damaged (even in a 'clearance' category)
- Wholesale clients are permitted to use The Blackened Teeth's product photography images that are found on our retail website (www.theblackenedteeth.com)
General
- Customers must make The Blackened Teeth Ltd aware if their business trading name and the registered account business name differ in any way.
- As of 13thMarch 2022, our sales order processing is now automated. By submitting your order you are confirming that all product, address, and contact information is correct. The Blackened Teeth Ltd will not be liable, financially or otherwise, if incorrect information has been entered.
- We no longer allow our customers to remove items from orders that have been picked and invoiced. While additions can still be made at this point, we do not have the staffing capabilities to remove items from orders that have already been picked and packed for dispatch. If items must be removed after invoicing, then a restocking charge will apply.
- Under no circumstances shall The Blackened Teeth be liable for loss of profit or any other economic loss.
